1. Scope of application
These General Terms and Conditions (GTC) of Lilienthal Lifestyle GmbH, Boxhagener Straße 78, 10245 Berlin, Germany (hereinafter “Seller”) apply to all contracts concluded by consumers within the meaning of § 13 BGB via the Seller’s online shop.
Sales are made exclusively to consumers. Orders from businesses within the meaning of § 14 BGB, for commercial purposes or resale, are excluded. The Seller is entitled to refuse or cancel such orders.
Translations of these GTC into other languages are for informational purposes only. The German version is authoritative and legally binding.
2. Conclusion of contract; ordering process
The presentation of products, particularly in the online shop, does not constitute a binding offer. Images and descriptions may deviate within reasonable limits and shall only be considered defective if the usability of the product is significantly impaired.
Orders can only be placed via the online shop. Orders by post, fax, or email are not accepted.
Before submitting the order, the customer receives an order summary allowing verification and correction of all details. By clicking the order button, the customer submits a binding offer to conclude a purchase contract.
The contract is concluded at the earliest of the following events:
- dispatch or order confirmation,
- charging of the payment method or payment instruction (e.g. PayPal, Klarna), or
- delivery of the goods.
The Seller may accept the offer within five days. If no acceptance occurs within this period, the offer is deemed rejected.
The Seller stores the contract text. The GTC, withdrawal information, and order details are sent by email. The contract language is German.
2a. Orders to Switzerland
For deliveries to Switzerland, the purchase contract is concluded between the customer and MeinEinkauf AG, St. Gallen, Switzerland (CHE-331.561.017 VAT).
MeinEinkauf AG handles customs clearance, invoicing, and delivery within Switzerland. These services are included in the purchase price and any shipping costs.
The customer is transparently informed that MeinEinkauf GmbH, Konstanz, Germany (DE285677365) is involved in the supply chain. No additional costs arise for the customer.
3. Prices and payment terms
All prices are final prices including statutory VAT. Any shipping costs are shown during the ordering process.
For deliveries to non-EU countries (except the United Kingdom), additional customs duties, taxes, and fees may apply and are to be borne by the customer.
The payment methods offered during checkout (e.g. credit card, PayPal, Klarna, Sofort) are available. The terms of the respective payment providers also apply.
4. Retention of title
The goods remain the property of the Seller until full payment has been made.
5. Delivery and shipping
Delivery is made to the address provided by the customer. In case of PayPal payments, the address stored with PayPal may be decisive.
Additional costs arising from incorrect address details or failed deliveries shall be borne by the customer if attributable to them. Statutory rights, in particular the right of withdrawal, remain unaffected.
Collection is not possible.
The delivery countries, delivery times, shipping costs, and any Incoterms stated in the “Shipping & Delivery” policy form an integral part of the contract.
The Seller is entitled to make partial deliveries. Each shipment may constitute a separate contract with its own shipping confirmation.
6. Pre-orders and delivery times
The online shop may offer products that are not yet available at the time of ordering (pre-order or backorder).
An estimated availability or delivery date may be shown on the product page. This date is for guidance only and is not binding.
Shipping takes place once the goods are available. In case of significant delay, the customer will be informed immediately and retains their statutory rights.
7. Right of withdrawal and voluntary returns
Consumers have a statutory 14-day right of withdrawal. The conditions are governed exclusively by our “Returns & Refunds (Withdrawal)” policy in its version valid at the time of order.
8. Return costs and return labels
Details regarding return costs, cost allocation, return labels, and the return process via the returns portal are governed exclusively by the “Returns & Refunds (Withdrawal)” policy.
9. Liability for defects and warranty
Statutory provisions regarding defects apply.
In addition, the Seller grants a three-year warranty for manufacturing defects where stated for the product. Statutory rights remain unaffected.
10. Repair services
10.1 Performance of repair services
The provider may have repair services carried out in whole or in part by qualified third-party companies (subcontractors). Partner:

10.2 Shipping and transport
Shipping for repair purposes is carried out at the provider’s cost and risk.
10.3 Warranty and liability
Statutory provisions apply. The provider is liable for third parties as for its own vicarious agents.
11. Liability
The Seller is fully liable for intent, gross negligence, and injury to life, body, or health.
In cases of slight negligence, liability is limited to essential contractual obligations and foreseeable damage.
12. Vouchers
Voucher terms apply. No cash redemption possible.
13. Gift vouchers
Gift vouchers are transferable and valid for three years. No cash payout.
14. Order quantities and pricing errors
The Seller may reject orders with unusual quantities or obvious pricing errors.
15. Applicable law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
16. Jurisdiction
Statutory rules on jurisdiction for consumers apply.
17. Consumer dispute resolution
The Seller is neither obliged nor willing to participate in consumer dispute resolution proceedings.
18. Severability clause
If any provision is invalid, the remaining provisions remain valid. The statutory provision replaces the invalid clause.
